CONFERENCE REGULATIONS TESTWAREZ 2024

§ 1
DEFINITIONS

Ticket An electronic document issued by the Organiser after the Participant has registered on the Website and paid the ticket purchase price. The Ticket entitles the Participant to participate in the Conference according to the selected ticket type.

Location Sheraton Sopot Hotel located in Sopot, Powstańców Warszawy 10, 81-718 Sopot.

Access code An individual code generated by the Organiser consisting of a string of characters that can be used to purchase a Ticket without the person purchasing the Ticket having to pay the Ticket price.

Conference An academic conference-type event organised by the Organiser called “TestWarez 2024”, to be held at the Location from 6-8 November 2024.The aim of the Conference is to support the development of people interested in software testing and IT analysis, forming a community of IT testers and business analysts.

Materials Any kind of information, data carriers on which any content has been recorded in any way, in particular such as teaching aids, documents, diagrams, films, animations, presentations, brochures, leaflets relating to the topic of the speaker’s lecture, which will be distributed by the speaker during their speech at the Conference.

Recording Audio-video recording, as well as photographs taken by the Organiser or an entity acting on behalf of the Organiser during the Conference.

Organiser Stowarzyszenie Jakości Systemów Informatycznych (Polish Testing Board) with its registered office in Warsaw (00-680) at ul. Poznańska 16, lok. 4, entered in the register of associations, other social and professional organisations, foundations and public health care institutions kept by the District Court for the capital city of Warsaw in Warsaw, XII Economic Division of the National Court Register under KRS no.: 0000175199, holding NIP no.: 5272426649 and REGON no.: 015596805.

Partner A natural person of full legal age who co-operates with the Organiser in the organisation of the Conference or has been invited to the Conference as a guest or a representative of a legal person or organisational unit without legal personality who co-operates with the Organiser in the organisation of the Conference.

Speaker A natural person of full legal age who has entered into an contract of mandate with the Organiser to deliver a lecture or conduct a workshop during the Conference.

Conference Regulations The present Regulations of the Conference.

Website Website administered by Polish Testing Board and accessible at: https://konferencje.sjsi.org

Participant A natural person of full legal age who purchases a Ticket in accordance with the provisions of these Conference Regulations.

Workshops Full-day activities organised as part of the Conference on 6 November 2024. Participants can choose from no less than 10 Workshop topics. The choice of Workshop made at the time of purchasing the Ticket is binding and it is not possible to change the chosen Workshop to another Workshop.

Entry ticket An electronic document issued by the Organiser upon registration on the Website by a Partner or Speaker. The Entry ticket entitles the holder to participate in the Conference in accordance with its scope.

Lectures Activities organised as part of the Conference on 7-8 November 2024. 

§ 2 GENERAL PROVISIONS

  1. These Conference Regulations define the conditions of participation in the Conference, as well as the rights and obligations of the Organiser, Participants and Speakers.

  2. The Conference will take place from 6-8 November 2024 at the Location. A detailed programme for the Conference, including a description of the Lectures and Workshops, is available at https://2024.testwarez.pl/agenda/

  3. The organiser reserves the right to change the Conference programme in the event of circumstances which make it objectively impossible to implement the Conference programme in its original form, in particular in the event of circumstances beyond the Organiser’s control, such as changes in generally applicable laws or the occurrence of force majeure, which is to be understood as sudden and unpredictable illness or indisposition of the Speakers, as well as epidemics of infectious diseases.

  4. The Conference is organised to disseminate knowledge, good practice and integrate the professional community:

    a) testing and software quality,

    b) business/systems analysis (in IT), including quality assurance processes,

    c) requirements engineering,

    d) usability,

    e) security,

    f) automation,

    g) designing new solutions and services,

    h) accessibility,

    by creating an environment for the exchange of experiences and encouraging discussion on the above topics.
  1. All important information concerning the Conference, including possible notifications of changes to these Conference Regulations, will be published on the Conference website, i.e. testwarez.pl, or other media channels such as the Facebook profile and LinkedIn.

§ 3
CONDITIONS FOR PARTICIPATION IN THE CONFERENCE

  1. You can participate in the Conference as an Participant, Partner or Speaker.

 PARTICIPANTS

  1. For Participants, participation in the Conference is paid. The price of participation in the Conference depends on the selected type of Ticket and the date of its purchase. The following types of Tickets are available:

    a) Early Bird Option – sale from 17 June 2024 to 30 June 2024 23:55.
  • PLN 1 599 net – Lectures within the Conference on 7-8 November 2024;
  • PLN 1 499 net (TICKET ONLY FOR PERSONS HAVING ANY ISTQB® CERTIFICATE) – Lectures within the Conference on 7-8 November 2024;
  • PLN 1 799 net – Workshop on 6 November 2024 + Lectures within the Conference on 7-8 November 2024.
  • PLN 1 699 net (TICKET ONLY FOR PERSONS HAVING ANY ISTQB® CERTIFICATE ) – Workshop on 6 November 2024 + Lectures as part of the Conference on 7-8 November 2024.

    b) Regular Option – sale from 1 July 2024 to 22 October 2024 at 23:55.
  • PLN 1 699 net – Lectures within the Conference on 7-8 November 2024;
  • PLN 1 599 net (TICKET ONLY FOR PERSONS HAVING ANY ISTQB® CERTIFICATE) – Lectures within the Conference on 7-8 November 2024;
  • PLN 1 899 net – Workshop on 6 November 2024 + Lectures within the Conference on 7-8 November 2024.
  • PLN 1 799 net (TICKET ONLY FOR PERSONS WHO HAVE ANY ISTQB CERTIFICATE®) – Workshop on 6 November 2024 + Lectures as part of the Conference on 7-8 November 2024.

    All prices listed  are net prices, which means that they will be increased by Value Added Tax (VAT) of 23%.
  1. Participation in the Conference as a Participant is only possible through the purchase of a Ticket. Tickets can only be purchased through distribution conducted via the Website. The conditions of use of the Service are set out in the Regulations of the Website.

  2. The number of available Tickets is limited. The sale of Tickets will start on 17 June 2024 and will continue until 22 October 2024 at 23:55 or until the date on which the entire pool of Tickets is sold out in advance.

  3. In order to purchase a Ticket, one should enter the website of the Website, correctly fill in a registration form, marking the type of Ticket chosen and providing necessary personal data. Then, one should tick the statement of accepting the provisions of these Conference Regulations and the provisions of the rules and regulations of the Website and electronic services provision. The registration process is completed by pressing the “I order a ticket with an obligation to pay” button, which is visible at the very bottom of the page.

  4. Registration for the Conference will be confirmed by the Organiser by way of an email sent to the email address provided during registration. This email will indicate all details of how to pay for the Ticket. In a subsequent email, the Organiser will also provide a Pro Forma Invoice with details of how to make the payment. Payment for the Ticket can only be made by bank transfer to the Organiser’s bank account.

  5. Some types of Tickets are intended only for people who have any ISTQB® certificate, in order to purchase such a Ticket, a legible scan or photo of the certificate should be attached to the registration form, allowing the Organiser to verify that the person purchasing the Ticket has an ISTQB® Failure to send a scan or photo of the certificate or sending the document in an illegible form, which makes verification impossible, will result in not being able to purchase a Ticket.

  6. As a rule, payment for the Ticket should be made in PLN, however, for those interested in payment in a different currency (USD/EUR), the Organiser may issue a Pro Forma Invoice in a different currency, chosen by the person registering for the Conference. If you wish to make payment in a foreign currency (USD/EUR), please inform the Organiser by writing an appropriate comment in the “Comments” section when placing your order. Upon receipt of information about the desire to make payment in a foreign currency, the Organiser will issue and deliver a pro forma invoice in the currency chosen by the Participant. The price of the Ticket will be converted into the chosen currency on the basis of the average NBP exchange rate for a given currency published by the NBP on the last working day preceding the day of registration for the Conference.

  7. In order to finalise registration for the Conference and purchase the Ticket, payment of the entire price of the Ticket must be made within 7 days (from the date of receiving the email with the Pro Forma Invoice). Upon receipt of payment for the Ticket, the Organiser will deliver the Ticket electronically within 7 days of receiving payment by sending it to the email address indicated during registration.

  8. The moment the Organiser receives the payment for the Ticket, the contract between the Participant and the Organiser is concluded, the subject of which is the provision of the Organiser’s service consisting in the possibility of participation in the Conference in accordance with the selected type of the Ticket. The content of the concluded agreement, including the scope of obligations arising from it, is determined by the provisions of these Conference Regulations and the type of Ticket purchased.

  9. The received Ticket should be presented at the entrance to the Conference in a printed version or in an electronic version on a mobile device, allowing the Organiser’s personnel to verify the QR code placed on the Ticket.

  10. Persons who register for the Conference but fail to pay for the Ticket by the deadline referred to in paragraph 9 above will be automatically removed from the registration process, which will be equivalent to deletion of their registration.

    ACCESS CODES
  1. As part of B2B distribution, the Organiser will offer its contractors the possibility to purchase Access Codes. The rules for the acquisition of Access Codes will be defined by separate agreements between the Organiser and the entity purchasing the Access Codes.

  2. A person who receives an Access Code shall be entitled to purchase a Ticket in accordance with the provisions set out above, provided that:

    a) On the Website page, in the “Type of participation” field, select the option “I want to use an access code” and then enter the access code you received, provide your personal details and click the “I order” button,

    b) Purchasing a Ticket using an Access Code does not require payment for the Ticket, thus the Organiser will not generate a pro forma invoice and the person purchasing the Ticket will not be required to make payment,

    c) A specific type of Ticket is assigned to an Access Code, and therefore the person using the Access Code will not be able to choose, change the type of Ticket that has been assigned to the Access Code,

    d) The conclusion of the agreement between the Organiser and the person using the Access Code occurs at the moment of positive verification by the Organiser of the registration application made using the Access Code. The subject of the concluded agreement is provision by the Organiser of the service which consists in enabling the participation in the Conference to the extent resulting from the ordered Ticket. The content of the concluded agreement, including the scope of obligations resulting from it, is determined by the provisions of these Regulations and the type of purchased Ticket.

    SPEAKERS AND PARTNERS
  1. A person registering for the Conference as a Speaker or Partner is not required to make payment for the Entry ticket. In order to receive a Speaker’s or Partner’s Entry ticket, a duly completed registration form must be submitted. To confirm your registration, please then press the “ORDER” button.

  2. Upon verification of the registration application received, the Organiser will, no later than 5 days from the date of submission of the registration form, confirm the entitlement to participate in the Conference as a Speaker or Partner and provide an Entry ticket. The Entry ticket will be delivered electronically by sending it to the e-mail address indicated during registration. The received Entry ticket must be presented at the entrance to the Conference in a printed version or in an electronic version on a mobile device.

  3. Upon delivery of the Entry ticket and confirmation by the Organiser of the terms and conditions of participation in the Conference, an agreement is concluded between the Organiser and the person purchasing the Entry ticket (Partner or Speaker). The subject of the concluded Agreement is the Organiser’s provision of services consisting in enabling participation in the Conference to the extent resulting from the selected type of the Entry ticket. The content of the concluded Agreement, including the scope of obligations resulting from it, is determined by the provisions of these Conference Regulations and the type of the Entry ticket.

  4. If nothing else follows from the provisions of these Conference Regulations or from separate agreements, the Partner and the Speaker shall be entitled to all the rights and obligations of the Participant, with the exception of the obligation to pay for the Entry ticket. Thus, all regulations of these Conference Regulations that apply to Participants shall apply to the Partner and the Speaker.

§ 4
ORGANISER’S SERVICES

  1. Ticket / Entry ticket to the Conference is provided by:
  • Entry to all Lectures within the Conference,
  • Entry to the selected Workshop (applies only to Tickets or Entry ticket covering admission to the Workshop on 6 November 2024),
  • receiving a so-called “Welcome Pack” from the Organiser,
  • the possibility to have a meal (lunch) on the day of the Workshop, i.e. on 6 November 2024 (applies only to Tickets including admission to the Workshop),
  • the opportunity to have a meal (lunch), on each of the days of the Lectures, i.e. 7-8 November 2024,
  • the opportunity to attend the gala dinner and banquet on 7 November 2024,
  • Access to coffee service during breaks in Lectures/Workshops.
  1. The organiser does not provide:
  • services other than those provided for in the Conference programme,
  • accommodation during the Conference.

§ 5
RESTRICTIONS AND PROHIBITIONS

  1. During the Lectures and Workshops the consumption of alcoholic beverages and intoxicating substances such as drugs or legal highs is strictly prohibited.

  2. It is forbidden to order to the area where the Conference will be held any meals delivered by third parties as part of the provision of the catering service.

  3. Smoking is also strictly prohibited during the Conference, except in designated areas.

  4. Conference participants are not permitted to bring dangerous items into the Conference area, including, in particular, firearms or white weapons, explosives, pyrotechnics or flammable substances.

  5. Conference participants are not allowed to bring animals into the Conference area or bring any movable items that may pose a threat to the safety of Conference attendees (glass objects, sharp objects, bulky objects, musical instruments, electrical equipment with the exception of personal computers, computer peripherals and mobile phones, tools, etc.).

  6. During the Conference, it is forbidden to carry out any activity of a political, commercial, agitational, religious nature, as well as to conduct any kind of collections or other activities (e.g. happenings, signature collection).

  7. During the Conference it is forbidden to present banners, flags, banners or shouts which may have the purpose of causing disorder or security. It is also forbidden to present any content, slogans, etc., regardless of their form and method of recording, if they may cause offence or conflict, including, in particular, content that is offensive or demeaning to any person, social group, professional group, nationality on the grounds of their racial origin, gender, religion, political beliefs and views, sexual orientation, membership of a social group, sports preferences, etc.

  8. It is forbidden to make audio-video recordings of the Conference in whole or in parts without the consent of the Organiser.

  9. The Organiser or persons acting on its behalf, including, in particular, security, are entitled to refuse entry to the Conference area to holders of Tickets or Entry ticket who do not comply with the provisions contained in these Regulations.

  10. The organiser reserves the right to remove from the Conference any persons whose behaviour disrupts the Conference.

§ 6
IMAGE

  1. The Conference, including the Lectures and Workshops organised as part of the Conference, and in particular the statements of all Participants attending the Conference, will be recorded by the Organiser or entities acting on its behalf in the form of photographs and audio-video recordings. As a result of the recording, the image and statements of the Speakers and Participants will be recorded.

  2. The Producer of the Recording will be the Organiser or an entity acting on behalf of the Organiser.

  3. The Organiser has the right to record the images and statements of Participants and Speakers during the Conference. Acceptance of these Conference Regulations constitutes permission for the Speakers and Participants to record their image and statements, and waives any future claims against the Organiser for remuneration for the use of their image, voice and statements recorded as part of the Recording.

  4. The Organiser is entitled to use and distribute free of charge the image, voice and statements of the Participants and Speakers recorded during the Recording.

  5. The Organiser’s right to use the image and voice referred to above includes the use and dissemination of the image, unlimited in time, form and territorial space, as well as the use of statements (including in fragments) of the Participants and Speakers recorded as part of the Recording.

  6. The Organiser’s right to use the image and statements of the Participants and Speakers includes any use by the Organiser of the entire resulting Recording or parts thereof. This right includes in its scope all fields of exploitation known at the time of publication of these Conference Regulations, in particular the following:

    a) recording in any form on any medium (in particular light-sensitive tape, magnetic tape, DVDs, Blu-ray discs, CD-R, CD-RW, Video-CD, Mini Disc, computer hard drive, MP3 files, MP4 files) and with any technique,

    b) to publish the Recording in any form,

    c) reproduction using any analogue or digital technique (in particular, light-sensitive tape, magnetic tape, DVDs, Blu-ray discs, CD-R, CD-RW, Video-CD, Mini Disc, computer hard drive, MP3 files, MP4 files, uploading to a server),

    d) public display,

    e) public performance,

    f) terrestrial wireless broadcasting by any technique,

    g) terrestrial broadcasting by wire any technique,

    h) satellite broadcasting by any technique,

    i) re-emission by any technique,

    j) posting on the Internet,

    k) inclusion in materials related to the Organiser’s activities, in particular marketing and advertising materials,

    l) right of adaptation,

    m) multimedia use,

    n) making available to the public in such a way that members of the public may access the author’s image or expression at a time and place of their choosing – services at the request of the viewer,

    o) use of image and expression for promotional and publicity purposes,

    p) use of image and expression within the framework of a merchandising agreement.

  7. With the acceptance of these Conference Regulations, Participants and Speakers agree not to withdraw the consents and rights granted to the Organiser under this paragraph.

§ 7
PERSONAL DATA

  1. The Administrator of the personal data of Participants, Partners and Speakers is the Organiser. The Organiser has not appointed a Data Protection Officer. Access to the data is possible at the Organiser’s premises. In addition, the Organiser provides the e-mail address rodo@sjsi.org through which personal data can be contacted.

  2. The organiser processes personal data for the following purposes:

    a) the execution of the Conference, including the sale and issue of Tickets and Entrance ticket, verification of the identity of Participants, Partners and Speakers, performance of contracts concluded with Participants, Partners or Speakers,

    b) the creation of audiovisual and photographic documentation through the production of a Recording, in order to promote the Conference and the Organiser’s activities,

    c) fulfilment of the Organiser’s legal obligations,

    d) making settlements,

    e) to carry out marketing activities – provided that the data subject has given separate consent to receive marketing content,

    f) Pursuing or defending against claims asserted against the Organiser .

  3.  The legal basis for processing personal data is:

    a) performance of the contract (Article 6(1)(b) of the DPA) – to ensure that you can attend the Conference,

    b) fulfilment of the Organiser’s legal obligation (art.6(1)(c) RODO) – in terms of billing, data retention period and others,

    c) the Organiser’s legitimate interest (art.6(1)(f) RODO) – to comply with obligations under data protection legislation in order not to expose themselves to financial penalties and other liability,

    d) consent of the data subject (art.6(1)(a) RODO) – if the use of personal data is not necessary for the performance of a contract, the fulfilment of a legal obligation or does not constitute a legitimate interest of the Organiser, who may ask for consent for specific uses of personal data e.g. requesting marketing consent, including consent covering marketing of other controllers of personal data.

  4. The Organiser transfers personal data of Participants and Speakers to the following categories of entities:

    a) entities providing accounting services,

    b) to entities entitled to obtain personal data on the basis of legal provisions (authorities, courts, law enforcement agencies, etc.),

    c) entities cooperating in the organisation of the Conference, in particular IT service providers and subcontractors of the Organiser,

    d) to sponsors of the Conference (only if the data subject has given separate consent).

  5.  Personal data shall be processed for a legally justified period until the last of the grounds justifying their processing expires, e.g. the statute of limitations for claims arising from participation in the Conference, with the proviso that the Organiser intends to use the Recording, in which images and statements of Speakers and Participants may be recorded, indefinitely.

  6. Every person has the right to:

    a) access to the content of your personal data and receive a copy of your data,

    b) rectification (correction) of personal data,

    c) deletion of personal data,

    d) restriction of the processing of personal data,

    e) the transfer of personal data, if the data are processed on the basis of a contract or consent. The organiser will transfer the data to the data subject on an appropriate medium or send the data to the designated data subject,

    f) to object to the processing of personal data,

    g) to withdraw consent to the processing of personal data at any time – where consent was given by the Participant or the Speaker,

    h) lodge a complaint with the President of the Personal Data Protection Authority.

  7. The provision of personal data is voluntary, but necessary to participate in the Conference. Failure to provide personal data will prevent participation in the Conference.

  8. The Organiser does not intend to transfer personal data outside the EEA. If personal data is transferred to third countries, i.e. to recipients located outside the European Economic Area or Switzerland, in countries which, according to the European Commission, do not provide sufficient data protection, the Administrator transfers the data using mechanisms in accordance with applicable law, which include, among others, the following.

    a) “EU Standard Contractual Clauses”,

    b) obtaining a certification of compliance with the Privacy Shield by a third party (if based in the United States),

    c) when the transfer of data takes place to a third country for which the European Commission has made a determination on the basis of a decision that the third country meets an adequate level of protection.

  9. The Organiser does not make automated decisions on the basis of personal data, including profiling.

§ 8
COOPERATION WITH SPEAKERS

  1. The moment the Speaker publishes or distributes the Materials during the Conference, it shall follow that the Speaker grants the Organiser a non-exclusive licence to use the Materials. Thus, the Organiser shall acquire the right to use the Materials to the extent specified in these Conference Regulations.

  2. The licence granted will not be territorially restricted in any way, which will entitle the Organiser to use the Materials throughout the world, without any territorial restrictions.

  3. The licence is granted for a period of 20 years, and the Speaker undertakes not to terminate it. The licence granted covers all fields of exploitation indicated in § 6 item 6, in particular the following: recording, publishing, dissemination on the Internet, including in particular publication on the Organiser’s website registered at the domain sjsi.org or the Organiser’s account at https://youtube.com.

  4. The Organiser is entitled to grant further sub-licences to the Materials.

  5. The Organiser is obliged to respect the personal copyright of the Speaker, in particular the integrity of the content and form of the Materials.

  6. By accepting these Conference Regulations, the speaker declares that he/she will be the sole author of the Materials, as well as that at the time of publication of the Materials at the Conference he/she will be entitled to exclusive, full and unlimited property copyright and moral rights to the Materials presented by him/her.

  7. By accepting these Conference Regulations, the Speaker undertakes that the Materials will be the result of his/her author’s work and that they will not infringe any rights vested in third parties, in particular author’s economic rights, author’s personal rights or industrial property rights. Furthermore, the Materials shall not infringe good morals, any rights of privacy or publicity, or any patents, protective rights granted for: industrial design, utility model or trademark, as well as any copyright, trade secret, recording rights, performance rights, as well as any other rights of third parties. Furthermore, the Speaker warrants that no content contained in the Materials shall be obscene, defamatory or that would otherwise violate any act of law in any territory or generate an obligation on the part of the Organiser to pay to a third party an appropriate benefit such as compensation or damages.

  8. Materials must not be promotional or advertise any products or services. The lecture and the Materials should only cover substantive aspects of the lecture topic and other forms of content presentation.

  9. The Speaker shall be fully liable to the Organiser for any legal defects in the Materials, which means that if the Organiser suffers any damage in connection with the delivery of the lecture during the Conference and the use of the Materials, the Speaker shall be obliged to compensate the Organiser in full.

§ 9
COMPLAINTS

  1. Each Participant and Speaker is entitled to lodge a complaint with the Organiser. Complaints may be filed electronically by sending them to the e-mail address contact@testwarez.pl or in writing. Complaints made in writing should be delivered to the Organiser’s address.

  2. The complaint should include at least:

    a) the subject matter and scope of the complaint and the grounds for the complaint,

    b) designation of the Participant/Speaker – their personal data enabling the Organiser to identify the Participant/Speaker, e.g. name and surname and e-mail address indicated during registration for the Conference.

    If the filed complaint does not contain the above-mentioned information, the Organiser is entitled to call the person filing the complaint to supplement the complaint. If the lodged complaint does not contain data making it possible to contact the person lodging the complaint, the Organiser is entitled to leave the complaint unprocessed.
  1. The Organiser will consider the complaint within 14 days of receipt.

  2. The Participant / Speaker who has lodged a complaint will be informed of the manner in which the complaint has been resolved. The response to the complaint will be addressed to the person lodging the complaint in the form of an e-mail – if the complaint was lodged in this way or in writing, if the complaint was lodged in writing. The position of the Organiser contained in the response to the complaint is the final position.

  3. Leaving a complaint unprocessed or failing to acknowledge it does not affect the rights of the complainant to assert his or her rights and claims through legal proceedings.

§ 10
WITHDRAWAL FROM THE CONTRACT

  1. Any person who has purchased a Ticket or an Entrance ticket is entitled to withdraw from the agreement concluded with the Organiser without incurring any costs and without giving any reasons within 14 days from the date of concluding the agreement for participation in the Conference.

  2. The declaration of withdrawal may be made in the form of an e-mail and sent to contact@testwarez.pl. If the declaration of withdrawal is made in writing, it is sufficient to send this declaration by registered mail to the Organiser’s address. In the event of withdrawal from the contract within the aforementioned period, the contract shall be deemed not to have been concluded.

  3. A temple declaration of withdrawal is attached as Appendix 1 to the Terms and Conditions, however, the person withdrawing from the contract is not obliged to use this temple.

  4. In the event of withdrawal from the agreement by the abovementioned deadline, the agreement shall be deemed not concluded. Therefore, the Organiser shall refund to the Participant the price of the Ticket paid by their immediately, but no later than within 14 days of receiving the statement of withdrawal from the contract.

  5. In the event of cancellation, the Ticket or Entrance ticket will lose its validity.

  6. In the event that the agreement for participation in the Conference is concluded and the time remaining from the conclusion of the agreement until the commencement of the Conference is shorter than 14 days, the Participant wishing to participate in the Conference is obliged to submit to the Organiser a statement containing an explicit request for the commencement of the service before the expiry of the deadline for withdrawal from the Agreement.

  7. In the event that the agreement for participation in the Conference is concluded and the time remaining from the conclusion of the agreement until the commencement of the Conference is less than 14 days, the Participant shall be entitled to withdraw from the Agreement until the completion of the Participant’s participation in the Conference. Completion of participation in the Conference is tantamount to performance by the Organiser, with the express consent of the Participant, which consequently results in the loss of the right to withdraw from the Agreement as a result of performance by the Organiser.

  8. The Participant shall not have the right to withdraw from the contract if the Organiser has performed the service (ensuring participation in the Conference) in full with the express consent of the Participant, who was informed before the performance started that after the Organiser’s performance, the Participant will lose the right to withdraw from the contract.

  9. The rights set out in this paragraph shall apply exclusively to consumers and natural persons concluding a contract directly related to their business activity, for whom the contract concluded is not of a professional nature, arising in particular from the subject of their business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

§ 11
FINAL PROVISIONS

  1. The content of the Conference Regulations is effective as of 16 June 2024. The Conference Regulations are available electronically at https://testwarez.pl/regulamin.

  2. These Conference Regulations are an integral part of the contract concluded with the Participant and the Speakers.

  3. These Terms and Conditions shall be governed by the laws of Poland.

  4. A participant who is a consumer may obtain free assistance on their entitlementss and on a possible dispute with the Organiser from the District/Municipal Consumer Ombudsman or social consumer organisations.

  5. At https://ec.europa.eu/consumers/odr, consumers can access a platform for resolving consumer disputes.

  6. The Organiser does not apply the code of good practices referred to in article 2 item 5 of the Act of 23 August 2007 on counteracting unfair market practices.

  7. The Organiser reserves the right to amend these Conference Regulations only if the change of the applicable law affects the scope of the services provided or the content of the provisions of the Conference Regulations, in particular imposing on the Organiser the need to amend them. Each time when the need to change the Conference Regulations arises, the Organiser shall immediately inform about the scope of changes to the Conference Regulations and the date of their introduction, so that each Participant and the Internet user could familiarise themselves with the new provisions of the Conference Regulations. If the Conference Regulations are changed, the Organiser shall provide the Participants with the possibility of terminating the concluded agreement.

  8. Any disputes arising between the Participant and the Organiser shall be settled by the competent court in accordance with the Code of Civil Procedure of 17 November 1964.

  9. All annexes to the Conference Regulations shall form an integral part thereof.

  10. The Organiser reserves the right to interpret these Conference Regulations and to issue additional instructions.

  11. The Organiser shall not be liable for any personal or property damage to Participants that may occur in connection with the Conference, in particular the Organiser shall not be liable for loss of movable property brought to the Location.

  12. Participants take full responsibility for the correctness of the data provided,
    in particular contact details.

  13. Any organised promotional activity during the Conference, in particular advertising of one’s own business and recruitment of employees, can only be carried out with the Organiser’s consent.

  14. During the Conference, Participants are obliged to observe the health, safety and evacuation regulations in force at the Location, as well as the provisions of the Location’s rules and regulations.

  15. If any provision of these Conference Regulations is declared invalid or ineffective by a final court decision, the remaining provisions of the Conference Regulations shall remain in force. The invalid / ineffective provision will be replaced by the rule that comes closest to the purposes of the provision declared invalid / ineffective.

  16. Participants are obliged to obey the instructions of the Organiser’s security staff and other security services to ensure safety.

  17. Participants acknowledge that in the event that the Organiser or persons acting on the Organiser’s behalf determine that a given Participant, by his/her behaviour, violates the provisions of these Regulations or generally applicable laws, the Organiser or persons acting on the Organiser’s behalf may decide to remove the Participant from the Conference.
